TERMS AND CONDITIONS

In all the following conditions the seller is TAYT Home Ltd and the buyer is the company, partnership, sole trader or individual purchasing goods from the seller.  The statutory rights of the buyer are not affected by these conditions.

  1. General; all orders are accepted subject to the following terms and conditions.

  2. Order confirmation; whilst TAYT Home endeavour to ensure all quotations are accurate it is the buyer’s responsibility to check the final details on the quotation are correct to your specification including sizes. Any changes after the manufacture commences will be the responsibility of the buyer unless an error has occurred in the actual manufacturing process. The receipt of a purchase order or a payment will confirm these checks have been made.

  3. Payment; orders are to be paid for in full, prior to manufacture. Once a written confirmation to proceed has been received from the buyer an invoice will be raised by the seller for the total payment.

  4. Deposits; deposits may be accepted in unusual circumstances. Once a written confirmation to proceed has been received from the buyer an invoice will be raised by the seller for the total payment requesting a 50% deposit. The remaining 50% balance is required to be paid prior to dispatch of the goods; this will be communicated in writing. Orders will not be delivered unless the balance is clear.

  5. VAT; Vat is applicable to prices in accordance with UK legislation in force at the tax point date.

  6. Delivery date; the estimated delivery dates provided to the buyer start from receipt of payment. The seller undertakes to use their best endeavours to dispatch the goods promptly and to keep any promised delivery date issued by the manufacturer, but does not guarantee to do so. Time of the delivery shall not be the essence of the contract unless expressly stipulated in writing and accepted in writing by the seller. The seller cannot be held liable for unforeseen delays by the manufacturer that are beyond their control. Every effort will be made to minimise any such delays.

  7. Delivery cost; the cost of the delivery shall be invoiced separately, once the order has been received by the seller and it’s quality has been approved. A suitable courier will be offered and an invoice will be raised for the buyer. Once paid, the goods will be dispatched to the buyer.

  8. Dispatch; once an order is ready to be dispatched by TAYT Home, the goods must be dispatched to the client within 7 days. Due to space restrictions, we are unable to hold orders beyond 7 days.

  9. Contract; These terms and conditions are on the understanding that any contract is between the seller and buyer only.

  10. Advice and Information; any advice, information and data provided by the seller whether verbally or in writing is given in good faith and without incurring any responsibility on the part of the seller.

  11. Variation; whilst every effort is made to limit any variation of the fabric in respect of colour shade the seller shall not be responsible where such variations are considered to be within commercially acceptable tolerances.

  12. Samples; for a bespoke order the seller recommends ordering a sample from the manufacturer beforehand, to ensure entire suitability. Samples will be offered by the seller, early on in the process. Prior to manufacture, the approved sample should be labeled ‘approved’ and a photo included within the purchase order.

  13. Claims; in signing for the delivery the buyer or recipient confirms that they have received the exact number of boxes as detailed on the packing list and shipment notice. Any missing boxes must be confirmed in writing with the driver and TAYT Home are notified within 2 days. All orders must be checked against the packing list and any missing or damaged products must be reported within a maximum period of 5 days after delivery date. Whilst TAYT Home will investigate any missing or damaged items TAYT Home will not take responsibility for items damaged due to handling at the buyer or recipient’s site or for items that are missing which are confirmed as manufactured and dispatched by TAYT Home and signed as received. Any boxes missing when dispatched by TAYT Home using their courier service will be covered under insurance. Any boxes missing when delivery is organised by recipients own couriers will not be covered and will need to be claimed through your own courier /company insurance.

  14. Cancellation; only certain goods can be cancelled prior to the dispatch from the manufacturer and according to the manufacturers’ own terms and conditions. For any personalised, or bespoke, or made to order goods, orders are non-refundable. Cancelled orders incur a 10% admin fee and additional return fees may apply from the manufacturer.
